1. Acceptance of Terms
By accessing or using EraseWatermark.io (the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service. These terms apply to all visitors, users, and anyone who accesses or uses the Service.
2. Description of Service
EraseWatermark.io provides AI-powered watermark removal for images, PDFs, and videos. The Service is available as a web application and via API. Some features are available without an account; others require registration and may require purchasing credits.
We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
3. User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.
You must be at least 16 years old to create an account. By registering, you represent that the information you provide is accurate and complete.
4. Credits & Payments
The Service operates on a credit-based model. Credits may be obtained through free daily allocations, signup bonuses, subscription plans, or one-time purchases. Credits are non-transferable unless required by applicable law.
Subscription plans renew automatically at the end of each billing period. You may cancel your subscription at any time; access continues until the end of the current billing period. Payments are processed by Stripe. By making a payment, you agree to Stripe's terms of service.
API credits purchased as one-time packs never expire. Subscription credits are added at the start of each billing cycle.
5. Acceptable Use
You agree not to use the Service to:
- Remove watermarks from content you do not own or have explicit permission to process
- Infringe any third-party intellectual property rights
- Upload or transmit malicious code, viruses, or harmful content
- Attempt to reverse engineer, decompile, or extract the underlying AI models
- Resell or redistribute the Service or its outputs without written permission
- Circumvent rate limits, access controls, or other technical restrictions
- Use the Service in any manner that could damage, disable, or impair it
We reserve the right to suspend or terminate accounts that violate these restrictions.
6. Your Content
You retain ownership of any files you upload to the Service. By uploading content, you grant us a limited, non-exclusive, royalty-free licence to process your files solely for the purpose of providing the Service to you.
Uploaded files and processed outputs are stored temporarily and deleted after download or within 24 hours, whichever is sooner. We do not use your files to train our AI models or share them with third parties except as necessary to provide the Service.
You represent and warrant that you have all necessary rights to upload and process your content, and that doing so does not violate any applicable law or third-party rights.
7. Intellectual Property
The Service, including its design, software, algorithms, and content (excluding user-uploaded files), is owned by EraseWatermark.io and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
The EraseWatermark.io name and logo are trademarks of EraseWatermark.io. You may not use our trademarks without prior written permission.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted or error-free, or that watermarks will be removed from every file or to your satisfaction. AI-based removal may produce imperfect results depending on image complexity.
9. Limitation of Liability
To the maximum extent permitted by applicable law, EraseWatermark.io and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.
Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.
10. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. You may delete your account at any time from your dashboard.
Upon termination, your right to use the Service ceases immediately. Any unused credits will be forfeited. Sections that by their nature should survive termination shall survive.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or by posting a notice in the application. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.
